In an unsigned opinion, it says Venezuelan migrants must file habeas petitions in the district where they’re confined (usually Texas, which falls within the 5th Circuit. BUT the majority says Venezuelan migrants MUST be given notice that they’re being deported under the Alien Enemies Act and an opportunity “to actually seek habeas relief” before they’re removed. The majority affirms their right to due process—this is a big deal. Picking up on this point, Justice Sotomayor writes in dissent: “To the extent the Government removes even one individual without affording him notice and a meaningful opportunity to file and pursue habeas relief, it does so in direct contravention of an edict by the United States Supreme Court.” An extraordinary separate dissent from Justice Jackson accuses the majority of trying to pass off its dirty work under the cover of the shadow docket and explicitly invokes Korematsu, the Japanese internment case.
