Tuesday’s Politics Thread has a case of the Mondays

Which is fine because I’m typing this on a Monday. And I’m cranky in a willful, “it’s Monday” kinda way. So there.

So it looks like that per curiam (unanimous) decision by SCOTUS didn’t start out that way. Per Mark Stern of Slate, who went digging through the metadata: “If you double click where it says “JJ.” at the top, then copy and paste it, that line reads: SOTOMAYOR , J., concurring in part and dissenting in part. And if you do a control-F search for “SOTOMAYOR , J., concurring in part and dissenting in part,” it highlights that same line. It looks like the liberals’ opinion was originally styled as a partial dissent written by Justice Sotomayor, but got changed to a concurrence in the judgment authored jointly by all three liberals.”

Per Marcy Wheeler (emptywheel): “What if Sotomayor’s partial dissent was turned into a concurrence in exchange for hearing the immunity claim this term? Given the timing, I just feel like they’re linked in some way (beyond the principle that Jack Smith could prosecute Trump for inciting insurrection).”

Per Secrets and Laws, a former CIA attorney: When the CIA produces a document in a FOIA case, it redacts it, prints it, and then scans it again, ensuring no meta-data. It’s been criticized for this practice as it slows things down and renders non-OCR’d PDFs, but seems worthwhile to me!”

Looks like there was some wheelin’ and dealin’ going on at the SCOTUS. Roberts must have reeeeeeeeeally wanted a 9-0 decision on this. Hope the liberal justices don’t get burned by this. And I got all of this off Twitter, so check screen names if you want to see the original tweets.

Anyway, that’s all I’ve been focused on today. I know there’s other stuff going on, but this decision was a weird one. I thought it was an inevitable one, but now seeing the machinations of how it might have gone down have me in a pondering mood.
